Chippewa Twp Vote to Adopt Ordinance to Allow Drilling per Act 13 – Beaver Falls, PA
NOTICE is hereby given that the Board of Supervisors of the Township of Chippewa intends to adopt Ordinance No. 244 at its regularly scheduled meeting to be held on Wednesday, August 8, 2012, at 3:00 p.m. at the Chippewa Township Municipal Building, 2811 Darlington Road, Beaver Falls, Pennsylvania 15010.
Ordinance No. 244 amends Chapter 27, Part IXX of the Chippewa Township Code of Ordinances by adding Section 1914 to Part IXX of Chapter 27, which is the Zoning Ordinance of the Township.
Ordinance No. 244 implements those items of zoning which the General Assembly of the Commonwealth of Pennsylvania permitted local municipalities to regulate as it pertains to the oil and gas operations under Act 13 of 2012.
Section 1914 I provides for relevant definitions pertaining to oil and gas operations. Section 1914 II provides for zoning classifications. Assessment operations, oil and gas wells, and oil and gas sites are permitted in all zoning classifications of Chippewa, provided that the well head or well site is at least 500 feet from any existing building. Oil and gas sites are prohibited unless the outer edge of the well pad is at least 300 feet from any existing building. Impoundment areas are permitted in all zoning districts used for oil and gas operations provided the edge of the impoundment area is not closer than 300 feet from an existing building. Natural gas compressor sites are a permitted use in the AR-1, ART and IC zoning districts, and a conditional use in all other zoning districts of the Township. Certain distance and noise requirements pertain to this use. Natural gas processing plants are a permitted use only in the IC zoning district of the Township, and as a conditional use in the AR-1 and ART districts. Certain distance and noise requirements also pertain to this use.
Section 1914 III defines the applicability and scope of Ordinance No. 244.
Section 1914 IV sets forth the permitting requirements for oil and gas operators, and Section V provides for an optional pre-permitting conference.
Section 1914 VI provides the criteria for a permit to conduct oil and gas operations within Chippewa Township, and Section 1914 VII sets forth the requirements as to use of local and collector streets, height, setbacks, screening, fencing, lighting, noise and hours of operation.
Section 1914 VIII provides for the severability of each provision of the Ordinance, and Section 1914 IX provides for penalties for the violation of Ordinance No. 244.
The Ordinance also repeals in its entirety Ordinance No. 238, which was enacted by the Township prior to the passage of Act 13 of 2012 by the General Assembly.
A Public Hearing on the proposed amendment to the Zoning Ordinance will also be held at 2:30 p.m. immediately preceding the regular Supervisors meeting at the Township Municipal Building.
